The customer acknowledges being fully informed that their agreement regarding the content of these General Terms and Conditions of Sale (GTC) does not require a handwritten signature of this document.

All these details are provided in French. The consumer declares to understand this language and to have full legal capacity to commit to these GTC.
Article 1 - Entirety
These GTC represent the full obligations of both parties. In this sense, the customer accepts without reservation all the provisions set forth in these GTC. No other general or specific conditions may be incorporated into these terms.
Article 2 - Purpose
The purpose of these GTC is to define the rights and obligations of the company FANOUS SHOP (the company selling products on the website it operates: www.fanous.ma) and its clients (individual consumers and professionals) within the framework of product sales through the e-commerce site www.fanous.ma.

Article 3 - Entry into force and duration
The conditions applicable are those in effect on the website at the time the order is placed. FANOUS SHOP reserves the right to modify, without notice and at any time, these GTC, with the changes being applicable to all orders placed after such modifications.
Article 4 - Electronic validation
Placing an order constitutes an electronic signature, which has, between the parties, the same value as a handwritten signature.
Article 5 - Order confirmation
Contractual information will be confirmed by email, SMS, or phone call at the latest upon delivery or, if not, to the address or number provided by the consumer when placing their order. For any purchase of products prohibited from sale to minors, the customer certifies to be of legal age when placing the order. FANOUS SHOP cannot be held responsible if a purchase is made for a third party.
Article 6 - Proof of transaction
Computerized records, kept on the servers of FANOUS SHOP under reasonable security conditions, will be considered proof of communications, orders, and payments made between the parties. Orders and invoices are archived on reliable, durable, and secure media that can be produced as proof if needed.
Article 7 - Product information
FANOUS SHOP presents the products for sale on its site www.fanous.ma, with the necessary characteristics to comply with Article 3 of Law No. 31-08, which outlines consumer protection measures in Morocco, allowing potential consumers to be informed of the essential features of the product they wish to purchase before placing a definitive order.
Article 8 - Stock
Offers presented by FANOUS SHOP on the website www.fanous.ma are valid while stocks last.
Article 9 - Applicable prices
Prices are indicated in Moroccan Dirhams and are valid only on the date the order is sent by the customer. They do not include shipping fees, which are billed as additional costs.
Article 10 - Payment method
The total price of the items must be paid in cash upon receipt of the order after verifying the package. Discount coupons are not cumulative. Each order can only include one discount coupon. Expired coupons are permanently lost, whether they are percentage-based or monetary value-based discounts.
Article 11 - Product availability
If the ordered product is unavailable, the customer will be informed as soon as possible within five working days and will have the option to cancel their order, partially or entirely. Orders are prepared Monday through Friday, provided all products are available.
Article 12 - Delivery methods
Products are delivered to the address indicated by the consumer when placing the order. Delivery is performed by companies specializing in logistics. Delivery costs will be borne by the customer. The consumer must check the condition of the package upon receipt and report any damage to the delivery agent on the delivery slip, as well as to FANOUS SHOP within five working days. If the customer is absent during home delivery, an email or SMS will be sent, allowing them to pick up the package from the specified Post Office during business hours within 15 days.
Article 13 - Delivery issues due to the carrier
Any delivery issues (missing product, damaged package, broken product, etc.) must be clearly noted on the delivery slip as "written reservations," accompanied by the customer's signature. The consumer must also confirm this issue by sending a registered letter with acknowledgment of receipt to the delivery company within two business days following the delivery date, outlining the complaints. A copy of this letter must also be sent via email to: contact@fanous.ma
Article 14 - Delivery errors
The consumer must file a complaint with FANOUS SHOP on the day of delivery or at the latest on the first business day following the delivery for any claims regarding delivery errors or non-conformity of products in nature, quality, or quantity compared to the order. Claims made beyond this period will be rejected.
The complaint should be primarily sent by email to: contact@fanous.ma. For efficient processing, the consumer must specify the order reference on the delivery slip. Claims not filed in accordance with the above rules and within the allotted timeframe will not be taken into account, and FANOUS SHOP will be relieved of all responsibilities. Upon receipt of the complaint, FANOUS SHOP will assign a return or exchange number to the relevant product(s) and communicate this by email to the customer. Exchanges or returns can only take place after a return number has been assigned. In case of delivery error or exchange, all products must be returned to FANOUS SHOP in their original packaging via Amana, to the following address: Villa 4, Rue Nopalea, Lot 4 Secteur 17 Bloc I, Hay Riad - Rabat, Morocco.
Article 15 - Return conditions
Only products returned in their entirety, in their original, complete, and intact packaging (including accessories), and in perfect resalable condition will be accepted. Any product that has been damaged or whose original packaging has been damaged in a way that compromises its resale cannot be returned.
Article 16 - Partial invalidity
If one or more provisions of these GTC are held to be invalid or declared as such by application of a law, a regulation, or a final decision by a competent court, the other provisions will retain their full force and scope.
Article 17 - Non-waiver
The fact that one of the parties does not take advantage of a breach by the other party of any obligation mentioned in these GTC will not be interpreted in the future as a waiver of the obligation in question.
Article 18 - Applicable law
These GTC are governed by Moroccan law, including both substantive and procedural rules. In case of disputes, the client may file claims with FANOUS SHOP's Customer Service to seek an amicable solution.
Article 19 - Catalog price updates and order validation
The written information and descriptions, as well as accompanying photos on product sheets, can be modified without notice.
During collection updates, written descriptions and photos are deemed "Non-contractual." For further product details, the customer is advised to request confirmation of the online visual's accuracy before proceeding with the order.
The prices on our website are verified daily and validated by our services upon customer order and before shipment. Therefore, the customer may be informed that the recorded order is not accepted due to a technical incident or a pricing error. As such, the order will be immediately canceled, and the customer will be notified of this cancellation.
